When you need it

The heirs' own covering application to the HSVP Estate Officer, asking that a plot or house allotted to a person who has died be recorded in the name of the heir or heirs. You say in the questions whether the allottee left a will or not, and the letter changes to match.

With a will, the application relies on the will; without one, on the heirs the law gives the property to. Either way the office usually wants proof of death, proof of who the heirs are, a statement from every other heir that they do not object, and an undertaking to protect the authority from any later claim. The letter carries those promises and lists the papers. This is a request to the authority. It does not decide who the heirs are. If heirs disagree, settle that first. Not for: a living owner's sale or gift (use the HSVP Transfer Permission Application).

What follows is the position for this kind of document. The amount is set by the state the property is in and it changes, so the figure for your own state is worth confirming at the sub-registrar’s office before you pay anything.

Stamp duty

No stamp duty on the covering application; plain paper. The heirs' affidavits and the indemnity undertaking go on stamp paper of the value the office states. Any later deed carries stamp duty at the rate in force on its date.

Registration

This application is not registered. Any deed that follows is registered at the Sub-Registrar's office within the time the law allows. HSVP's own procedure (counter or online) and fee schedule are as the office states when you file.

Notarisation

The application is signed, not sworn. Each heir's affidavit and the indemnity undertaking are sworn before a notary or an Oath Commissioner.

Witnesses

No witness is needed for the application. A deed that follows needs the witnesses that deed requires.
