When you need it

For when a mortgage debt is fully discharged and a formal instrument must extinguish the mortgagee's security — unlike a no-dues letter, this acts on the property right itself. S.60, TPA 1882 gives the mortgagor, after payment, a right to re-transfer or acknowledgment. Since it extinguishes a property right, it's registered; Punjab freehold, authority allotments, and Chandigarh sector/revenue-village property each need their own local charge-record update. Release only the identified mortgage.

LEGAL BASIS

Punjab: Section 60 of the Transfer of Property Act, 1882 governs redemption. A release extinguishing an immovable-property mortgage right is registrable under section 17 of the Registration Act, 1908 and should be presented within four months under section 23; the jurisdictional Sub-Registrar receives it and refusal remedies follow sections 72 or 73. If the property is a development-authority allotment, the authority file under the Punjab Regional and Town Planning and Development Act, 1995 must also be aligned; section 43(7) is the authority-property transfer or mortgage permission provision.

What this document is for

A lender and a borrower use this once a mortgage loan in Punjab or Chandigarh has been fully repaid, to formally extinguish the lender’s charge on the property rather than simply saying the debt is settled. It names the original mortgage being released, confirms the debt is discharged, and states exactly what interest the lender is giving up — so the property’s title record shows the charge is gone, not just that the bank has stopped sending statements.

It exists because a loan closure letter or a no-dues certificate from the lender proves the debt is paid, but does not by itself touch the property right the original mortgage created. Where that mortgage was registered, only a registered release — presented at the same Sub-Registrar’s office — actually clears the record, which matters the next time the owner wants to sell, gift or re-mortgage the same property.

Before you rely on this — a bank letter alone does not clear the record

A bank’s loan closure letter or no-dues certificate is proof the debt is paid; it is not, on its own, what removes the mortgage from the property’s title record. Where the original mortgage was registered, this release deed has to be executed and separately registered before the charge actually disappears from what a buyer, a fresh lender or the Sub-Registrar’s own search will see.

Where the property is a Punjab development-authority allotment, or Chandigarh sector or estate property, there is a second file to align as well: the authority’s or the Estate Office’s own record of the mortgage has to be updated to show the release, separately from the Sub-Registrar’s. Treat the bank letter as the first step, not the last one.

Usually yes, if the original mortgage was registered. The closure letter is proof the debt is paid, but it does not itself touch the mortgage sitting on the property’s title record — only a registered release deed, presented at the Sub-Registrar’s office, actually clears that record. Treat the bank’s letter as the evidence behind this deed, not as a substitute for it.
