When you need it

Use this when an insurance company has rejected your complaint about a claim or a policy, given you an answer you cannot accept, or not replied within the time the rules allow, and you want the Insurance Ombudsman to look at it. It works for life, health, motor, travel, property and other policies.

It sets out the policy, what happened, your earlier complaint to the insurer, what you ask the Ombudsman to direct, and the papers you enclose. Complain to the insurer's grievance officer first, in writing, and keep the reply; the Ombudsman will usually not take up a complaint that the insurer has not first had the chance to settle. The Insurance Ombudsman Rules, 2017 set a time limit counted from the insurer's reply, a limit on the value of the claim the Ombudsman can award, and the bar on a dispute that a court or Consumer Commission is already hearing. Check all three with the Ombudsman's office before you file. The Ombudsman may also ask for its own complaint form; if so, fill it in and attach this complaint to it. Not the claim itself, and not a notice to the insurer — for those use the Health Insurance Claim Letter, the Appeal Against Claim Rejection or the Legal Notice to an Insurance Company. Not a complaint against a bank or lender; for that use the RBI Ombudsman complaint.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A letter asking an insurer to perform its own contract creates, transfers or ends no right, so it is not a chargeable instrument under the Indian Stamp Act, 1899. Plain paper is enough. Confirm with the Ombudsman's office whether any fee is charged for a complaint.

Registration

Punjab and Chandigarh: not registrable. It touches no immovable property, so section 17 of the Registration Act, 1908 does not reach it. Keep proof of the day it was lodged: the stamped copy, the email delivery receipt or the post receipt.

Notarisation

Punjab and Chandigarh: no notarisation is needed. If the insurer asks for a sworn statement, it will say which of its papers it wants sworn. The complaint is verified by the signed declaration at its foot.

Witnesses

Punjab and Chandigarh: no witness is needed. The signatory signs alone.
