When you need it

Use this when a tenant is breaking the terms of the tenancy in a way other than not paying rent: using the home for something other than living, letting someone else stay or take over without your consent, causing nuisance to neighbours, or damaging or altering the home. It sets out what is wrong, asks the tenant to put it right within a stated number of days, and records that you have not agreed to it.

It is a step before any court case, and it builds the record. It does not end the tenancy, and it is not a demand for possession. Under both of Punjab's rent laws misuse, subletting and nuisance can be grounds for asking the Rent Controller or the Rent Authority to order the tenant out, but the section, the procedure and the time limits differ. Punjab runs two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of the letting, and which of them covers your tenancy is something to confirm with a lawyer before you act. This notice therefore only says which law you understand to apply and does not state it as fact. Keep taking rent while the matter is open: the notice says that taking rent does not waive your complaint. Keep proof of how you sent the notice. Not for: unpaid rent (use the Notice of Demand for Arrears of Rent or the Notice to Quit for Non-Payment); ending a periodic tenancy (use the Notice to Quit); a person who was never a tenant (use the Notice to an Unauthorised Occupant).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is payable on a notice or letter of this kind: it creates or transfers no right. The cost is only the postage or courier charge.

Registration

Not registrable: a notice or letter is not an instrument the Registration Act, 1908 requires to be registered.

Notarisation

Not required. What matters is proof that it was sent and received: keep the postal receipt and tracking record, or a signed acknowledgement of delivery.

Witnesses

No witness is needed; the sender signs alone. A witness to a hand delivery is useful if delivery may later be disputed.

NOTICE OF BREACH OF TENANCY TERMS

Date: 2 April 2026

By: Registered post

To: Aarav Sharma, Flat 804, Maya Garden City, Zirakpur, Punjab

From: Harpreet Singh, House No. 45, Sector 21-C, Chandigarh

Subject: the home at Flat 804, Maya Garden City, Zirakpur, Punjab: breach of the terms of the tenancy

  1. 1. You have been the tenant of the home at Flat 804, Maya Garden City, Zirakpur, Punjab since 1 April 2026, under the rent agreement dated 1 April 2024.
  1. 2. I complain of your using the home for a purpose other than residence. The facts are: Since June 2026 a coaching class of about 15 students runs in the home every evening, and a stranger, Mr Rakesh Kumar, has been living in the back room since July 2026..
  1. 3. The terms of the tenancy broken are clauses 4 and 7 of the agreement. I have not agreed to what is complained of, in writing or otherwise.
  1. 4. You are asked to put this right within 15 days of receiving this notice: to stop what is complained of, to restore the home to its earlier condition where it has been damaged or changed, and to confirm in writing that you have done so.
  1. 5. Rent continues to be due. If I accept rent while this matter is open, that is not a waiver of my complaint and is not consent to the breach.
  1. 6. If it is not put right, I will consider the steps the law allows, including an application to the court or authority that decides rent matters, under the law that governs this tenancy, which I understand to be the Punjab Rent Act, 1995. This notice is a complaint and a request. It is not a notice to quit and it does not end the tenancy.
  1. 7. Please reply in writing within the same period. A copy of this notice is kept with proof of how it was sent.
